Here’s what we know right now:
Anti-abortion zealots are targeting mifepristone, a pill taken in conjunction with misoprostol for medication abortions in the US.
In an ongoing case (Louisiana v. Food and Drug Administration), Louisiana challenged an FDA regulation that expanded access to mifepristone. The state asked the court to “stay” the regulation, and revoke telehealth access until the FDA completes a review of mifepristone. The court placed the case on hold and mifepristone remained available via telehealth and by mail. Louisiana appealed to a higher court.
On May 1st, a Fifth Circuit panel ruled in Louisiana’s favor, making an in-person appointment required for mifepristone nationwide. Mifepristone manufacturers appealed to the Supreme Court right away.
On May 4th, the Supreme Court issued an administrative stay that paused the Fifth Circuit’s ruling and temporarily reinstated telehealth access. That stay was then extended on May 11th.
On May 14th, the Supreme Court granted an indefinite stay, blocking the Fifth Circuit’s ruling and preserving remote and by mail access to mifepristone. The stay is granted “pending disposition of the appeal,” meaning Louisiana v. Food and Drug Administration now returns to being litigated in the lower Fifth Circuit court, where it will be decided on its merits.
The case could make its way back up to the Supreme Court docket, or the FDA could complete their review and ultimately reinstate old restrictions on mifepristone, but it continues to be accessible via telehealth for now!
